| Education is an important part that related to the development of the country and the nation. All countries are very important to the development of education in a strategic position. But China has long-term existence of public education to outshine others, the development of private education is in difficult circumstances. Although we formulated the "Law of the People's Republic of China on Promotion of Privately-run Schools" and the implementation details, but these laws exist many defects, and did not meet "promote" the legislative purpose. Many of these practical difficulties which flourished at the private schools have closed down, private education into a dilemma. As we all know, private education bears the expansion of the education resources, education rich content and improve the education system, and so an important role in the development of its relations to the whole the development of education.The author believes that the reasons for China's private education lags behind including economic, policy, legal, ideas, history and tradition, and many other factors, legal aspects of the reasons is the most important aspect. Based on private education law in the relations between the government and private education for the relationship between the entry point, the administrative law on protection of private education were more systematically expounded. Of course, this does not exaggerate the administrative law on the role of private education, only that the absence of administrative protection of private education is an important reason for delay. Based on this, the paper discusses private education for the promotion and development from the administrative view.This paper is divided into three parts, the first part is about the content and the necessity of administrative protection of private education. The second part elaborates the foreign (including the United States, Japan) and the Taiwan region of China's private education legislation in order to bring these countries and the advanced legislative experience to draw on. Private education administration on the last part is about the building of the security system. Through legislation, law enforcement, relief, and other areas to further improve China's private education, with a view to really promote the development of private education. |
