Mao Zedong's constitution thought is an important part of regime theory, especially the democracy and legal construction theory of Mao Zedong's thoughts. Its content is abundant, going through the development of breaking autarchy, building constitution, and constitution nihilism, including the constitution thought of New Democracy and the constitution thought of the transition period from New Democracy to Socialism.Mao Zedong's constitution thought originates in the new democratic revolution period, and developed quickly in the socialist revolution period and the beginning of the socialism construction period. It is marked by several principals, such as democratic centralism, the separating of the party and the government, and people's sovereignty, etc.During the practice of leading China's revolution and construction, for the first time, Mao Zedong combined Marxism and the practice of china's revolution and construction, on the base of the experience of constitutionalism movement since modern times, developed the constitution thought of Marxism, and realized its localization in China. Mao Zedong analyzed the relationship of constitution and China's reality correctly, pointed out the essence of the new-democratic constitutionalism and the inevitability of the movement to socialism, and pioneered valuable exploration of the building of constitution system in China. As the founder of the first constitution in New China, Mao Zedong's practice is of important theoretical value, it also has deep historical lessons.For the change of conditions, both home and abroad, and the development of left-leaning thought, in Mao Zedong'later years, his constitution thought had a transmutation. The legal construction and the democratic constitutionalism movement remained stagnant. The legal authority faded. All of these promoted the establishment of the era of non- constitutionalism, featured by personal authority and arbitrariness of Mao Zedong.Taking the creation, development, and maturation as a clue, this thesis discusses Mao Zedong's constitution thought of New Democracy and the thought of administrating the nation according to the constitution, and analyzes the reason of its transmutation, which is of great realistic guiding significance to discuss how to inherit and develop Mao Zedong's constitution thought, construct socialist spiritual civilization and political civilization, and build the constitutional system with Chinese characteristics, under the new historical condition.
