Household Register System (here in after referrers to HRS) is a type of social population management system ; it is formed associated with the evolution of the nation, a basic administrative system of the country. Our current HRS management mode is a dual residency system that is based on《Residency Registration Law of PRC (1958)》, its core is "Residency Transform Registration Check and Approval System," featured by seriously difference between rural and urban residency. The dual residency system classifies residence into two groups: rural residency and non-residency ", different group consumes such different treatment as employment, education, social security and welfares. This system forbids transition between two groups, seriously violates the rights of equality and freedom granted by constitutional law. With the development of society, its drawbacks become increasingly clear. It impedes free flow of talents by controlling residency transition. And this hinders the process of urbanization and modernization. The central and local governments come to focus on the drawbacks of the system and many measures have been taken to eliminate the drawbacks. More and more scholars conduct more research and rethinking on the current HRS. Starting with the creation of our HRS and the reasons for it, this paper points out the insufficient in human rights protection, gives analyses and evaluation on the reform of present HRS, gives discussions on how to further promote reform of HRS on the base of law system and hopes to give some references on how to perfect the system.
