Law Research On China Household Institution Reform

The household register system of our country is an important part of chains of command and a main function of public security, From the view of social economy, the household register system, of 40 years history, is founded and formed and continues in a specific historical condition. The current household register system is based on The Household Register Regulation of P. R. of China and some other relevant household policies. At the beginning of its forming, It has played an active role in perfecting the national population register, keeping the social order, preserving people's rights and interests, keeping the number, structure, location of the population and labor in balance in urban and rural areas, enhancing economical and social development. However, with the establishment and perfection of marketing economy, the old household register system doesn't apply for the social development, and the marketing economy needs a kind of centralized household register system. This kind system is good for the justice and equality of the society. Referring to the international advancing experiences of household register management, the strategies to overcome the influence is to realize a centralized household register system. The reforming of current household register system has progressed in some aspects, however, the reforming is partial and in a small scale, but not affect the old household register system and relevant policies. Just because of the malpractice of the dualistic household register system, from practice and theory, it is in need of modifying. To reform the current household register system and establish a new, centralized household register system fit for the demand of socialistic market economy. First,government should modify the Constitution, resume and protect people's rights of living and migration. And then, should speed up making a law of household register management. Third, we need a unified and an equal household register system and carried out in the whole country. Our government should cancel the way of naming people farming and non-farming step by step, and eliminate the social function attached to this household register system model. And a centralized household register policy reform based on resident's identification card is needed, and this reform should be suitable for the idea of residence and free emigration and opening and unified in urban and rural areas.We must make sure of the resident's identification and recall the original function of the household register system for human resource statistics and effective social domination. And make a transition from household register system to population management. At last we must abolish the residence system and with only identification cards we can go and dwell anywhere in the whole country. Finally, in order to promote the reforming of the current household register system, this essay points out the problems and difficulties in this activity.
