With a large number of peasants have gone into urban areas to work since the eighties of last century, the term of"peasant workers" has taken shape in our society. As a special group in the development of our country, "peasant workers" has become a marginalized and discriminated group since it come forth, whose legal rights and interests can not be secured in our society. To get at the root of this matter, it' s said that the problem about "peasant workers" this years has rooted in the definition of status of "peasant workers" .Stepping from the Maine' s theory of "from Status to Contract" , this article studies the "peasant workers" of the other countries, and critics and reconsiders the term of"peasant workers" from semantics, legal history, legal sociology and normative jurisprudence. With the study of the term of "peasant workers" , this article argues that the term of "peasant workers" is a discriminatory term, and the status of "peasant workers" is a unequal status too. To solve the problem of "peasant workers" , effective policies must be taken to eliminate the identity of "peasant workers" and admit the status of "industrialist" in social life. In this way, the rights and interests of "peasant workers" can be faithfully protected.The status of "peasant workers" is the key of the problem of "peasant workers" . To work out the problem of "peasant workers" from the angle of jurisprudence, it must to administer an equal status to "peasant workers" , in order to make them be the subject of the right, and promote the development of the course of "rule by law" . It can make sense not only to the development of economy and society, but also to the construction of harmonious society and modernization.
