A Study On The Legislation Of American Animal Welfare

With the development of society,the progress of human civilization and the promotion of morality of human beings, more and more people share the idea of protecting animals to achieve the harmonious coexistence between man and animals.The incidents of the cruelties to animals happened frequently in recent years such as injuring bears with sulphoacid,drawing gallbladder from live bears,giving injections to live pigs and cruelty to cat.These incidents make Chinese people realize that the present Chinese Wild Animal Protection Law can not entirely protect all the animals in China.Thus the legislation of the animal welfare attracts Chinese people's more attention. Frankly,our country doesn't make Animal Welfare Act while the most other countries in the world have made animal welfare act, among which American Animal Welfare Act has its uniqueness.In the US,great achievements have been made in protecting animal welfare.First of all,the concepts of animal and animal welfare, the philosophical bases,the historical development and the legislative models of animal welfare act is introduced and analyzed in this paper.Then the historical development, legislative systems and the present performance condition of American Animal Welfare Act is analyzed.Subsequently the main content of American Animal Welfare Act is further discussed, in which the legislative purposes,basic principles,legal systems and legal liabilities are discussed in detail.On the basis of the discussion,an assessment is made about American Animal Welfare Act and some characteristics of American Animal Welfare Act are concluded.Then in accordance with the present condition and existing problems of the legislation of the animal welfare of our country,the author discusses the specific enlightenments which the legislation of American animal welfare brings to the legislation of Chinese animal welfare in the aspects of legislative purposes,basic principles,legislative systems and legal liabilities.In the end the author brings up some advice that China can use the valuable experience of the legislation of American animal welfare when China makes the Chinese Animal Welfare Act in future,hoping to promote the development of the legislation of animal welfare of our country.
