The Research On Economic Law Behavior Of Government And Enterprise

The problem of the correlation of government and enterprise is the center and focus in the research on economic law. Focus the research on this problem, some scholars have their standpoints, and this problem is still a new one remained to be renewed, because the correlation of government and enterprise is dynamic, development with the theory of the government and enterprise. On the standpoint of the result of study and my acquirement from learning, the present writer tries to interpret this problem from a new perspective, hoping to draw a reasonable conclusion through analysis. And this conclusion will benefit the society.Now, there are many theories about the problem on correlation of government and enterprise in the research on economy in domestic academic circles; professor Luzhongmei in Zhongnan Politics and Law university studies deeply on economic law behavior; his research on behavior law is still proceeding, and professor Xiebangyu in Central Communist Party University studies wholly on behavior law. Overseas scholars study the correlation of government and enterprise very deeply, especially on the behavior law. The Behavior of Law written by Donald J. Black is the representative in the field of behavior law. Although the present writer has not collected enough materials about this field, combining these three elements to elucidate, this thesis can be called, in some sense, an innovation. Falling across difficulties when exploring various materials, nevertheless, the present writer has done it independently.This thesis takes behavior law methodology as an entry to the further study and applies a new method, namely, the way of researching from behavior to theory, and then to behavior. The main body of the thesis composes four chapters to demonstrate the problem of economic law behavior of government and enterprise. There is behavior law methodology and economic law behavior in the first part, in which behavior law methodology and economic law behavior are separately introduced. On the other hand, the present writer also points out the way they connect with each other. The second chapter relates about economic law behavior of government and enterprise, in which the present writer further develops from the definition of government and enterprise to the relationship of the two and then to the economic law behavior of government and enterprise respectively. The third chapter is about the criterion of economic law behavior of these two elements, where demonstrates two criteria respectively from the two perspectives of government and enterprise as the follows: the criterion of economic law behavior of government, and the criterion of economic law behavior of enterprise. The fourth chapter is the conclusion and standing ground of this thesis that concerns about the behavior guide to government and enterprise, in which the thesis draws its conclusion. In some sense, the conclusion may have certain significance to the practical behaviors. Aiming at the actuality of the current study on the economic law behavior of government and enterprise and the law of economy, the present writer arrives at suggestion about this study finally.Applying a new approach, the present writer adopts a new method, and tries to develop a proposition that has not been fully discussed, and comes to draw the conclusion in the end. The present writer may hope the conclusion of this thesis may benefit the harmony of the connection of government and enterprise and may improve the development of the harmonious socialist market economy. And in this way, we may found a more harmonious society by the people and for the people.
