Discussion On Clinical Legal Education Of JM

With the implement of legal government of state and the development of legal modernization, the legal education develops rapidly. Thousands of students graduate from law school and join to the legal construction every year. Through the examination of practice, the graduates appear many problems. The fact indicates that the legal education exists plenty of shortcomings. The instruction of JM is a challenge to the traditional legal education. Discussed in 1993, demonstrated in 1994 and approved in 1995, JM has been disputed by jurists and educational experts for ten years. The disputed focus is how to transplant and localize western legal education. Some consider western legal education is technical which ignores the study of legal theory and professional ethics, which is different from the traditional education of law. Some think it is necessary to combine traditional legal education with western legal education. Because we live in a changeful society which exists many benefit contradictions and value conflicts. Modern legal education not only focuses on the study of theory but also emphasizes the practice of law, which promotes the law consciousness of people. Chinese JM which is based on the introduction of western professional education of law should keep in touch traditional legal education. I agree with the latter viewpoint that it is essential to introduce the clinical legal education for Chinese JM. As a JM, I think it is shortfall to grasp the basic theory and legal language in three years. So I consult some foreign views and native ideas from monograph, further, compare with western system of legal education and analyze the definition, history and characteristic of clinical legal education which enlightens Chinese JM education. Finally, I propose Chinese characteristics clinical legal education which is conducive to the study of JM education.
