Studies On The Present Situation Of Chinese Residents' Legal Consumption

Consumption takes an important part in the process of reproduction in human society. As time goes by, consumption patterns tend to be plural. Housing consumption, education consumption, medical expenses, gradually became the common consumption patterns. As the great strategy—" ruling the country by law" has been practiced, the legal consumption was concerned by the people more and more strongly, and becomes a daily consumption behavior. From the perspective of the prevention and the solution of the neighborhood disputes, this thesis studies on the present situation of Chinese residents' legal consumption from social empirical levelto value assessment level.From the empirical perspective, the legal consumption of Chinese residents mainly contains mediation, notaries, legal advice, litigation, arbitration, administrative registers, accepting law education and so on. From the main form of present legal consumption patterns, it can be seen that the legal consumption covers all aspects of life. The characteristics of legal consumption contain: the extensiveness of the body, consumption target of the statutory and the diversity of legal consumption, the multilevel nature of the legal consumption. Behind these characteristics embodied, two deeper characteristics show: one is the law (the state law) formed the order of the dominant society; the other is the residents agree with the law consciously, and "detest lawsuit" psychological expelled. We can analyze the reasons of increasing legal consumption from different angles. For example, the relations between legal consumption and per capita GDP, the relations between legal consumption and population density, the relations between legal consumption and the growth of individual right consciousness and so on. This article chose the social stratification theory to explain the reason of the increasing phenomenon of law consumption. It has first theoretically analyzed the influence of the social stratification on two key parts in legal consumption, "the supplies of legal consumption" and "the demand of legal consumption", following confirmed this theory with the real condition of social stratification in our country. Then a conclusion has been reached that in contemporary China, the multi-level social structures promoted the change and the development of law consumption.Judging from the value level, a social phenomenon such as the legal consumption needs to make the dialectical analysis. The residents' participation in the legal consumption can raise their legal awareness; can help legal enforcement being put into effect; can cause the legislative goal and the law value to be realized in social movement; and can make the law no longer being the offerings at Altars. The wrong idea or the improper behavior of law consumption will also hinder the law construction in our country government, such as the thought of that the law is nobler than a simple violence; the behavior of abusing own lawsuit right, wasting the national judicature resources recklessly; meanwhile, be alert to excessive dependence on law.To research the present will also be to grasp the future. Finally, the thesis has predicted the future prospect of the legal consumption. As "acquaintance society" has been broken and the interaction between social strata has formed, the legal consumption, in the future, will inevitably also continue to rise; The increase of legal consumption suggests that the Chinese citizens has formed the habit of lawconsumption on their own initiative, and suggests a transformation of ideas—frompassively accepting the fact of "delivering the law to the country" to actively consuming the law.
