On Statuary License In Internet Copyright

But after entering the digital era, the copyright owners'benefits are conflicting with the public'benefits. With the expansion of the copyright on the Internet, the copyright limitation becomes a hot topic that discussing the copyright realm again. The new techniques challenge the copyright system constantly, and request the lawmaking to follow this to make out the changes. Under internet environments, Exhaustion Doctrine, Fair use, Statuary license and Tacit agreement license all have great changes. Academic discussions on the limitations of Internet copyright mainly focus on issues of fair use, with less attention to Statuary license. Though it is both necessary and possible to establish rules on Statuary license under Internet copyright system, the scope of Statuary license should not be extended indiscriminately. Appropriate Statuary license system for Digital library and Internet textbooks used in distance education should be established; Reprint and compilation, which are common on Internet, should be excluded from legal license as far as possible. Hence the copyright law should take Statuary license in it's rile and system better, establish a new copyright limitation, make a new interest balance among of the copyright owner, disseminator and the public in new technique background.Apart from Introduction and Conclusion, the thesis consists of three parts. The Introduction mainly put forwards the background, the meaning of this thesis through a general description of the current study, and the argument methods. art one introduces the value and function of Statuary license patterns of copyright. It's the property of copyright that relates to comprehend the patterns directly. art two discusses that why establish rules on Statuary license under Internet copyright system is necessary? The most important reason is the predicament of license pattern of copyright under the digital circumstance. On one hand, it's more difficult to survey the copyright; on the other hand, the author also has the obstacles to license users. art three discusses the Digital library and Internet textbooks used in distance education should be establishing rules on Statuary license under Internet copyright system. Finally, the conclusion part sums up the whole argument and generalized the central topic of this thesis.
