Study On The Third Sector In The Sight Of Administrative Law

The English name of the third department is"Third Sector", proposed by American scholar Levitt initially. The academia has not totally reached common understanding in its intension at present. By contrast, this definition is more to admit which is recommended by the compared research center for the Nonprofit Sector of American John - Hob Money University. Following this standard, we will find it hardly exists totally in China. This concept can not agree with the reality of our country. But this can not deny the important meaning of study for this phenomenon in our country. In fact, there are some social organizations different from the government organizations and the enterprises in the form and operation mechanism, which play even the same function to"Third Sector"in reality. So, we should take the relenting attitude to it. We can't adopt the overly strict standard in the west in its intension and need to carry on the discussion of the localization.Analyzing from the historical background, we find that the third sector's production and developion contact closely with the administrative law in our country, it has important theory and realistic meaning to the development of the administrative law. On this base, this thesis attempts to break through the existing research mode, put the third sector in the sight of the administrative law, pursue"Chinese style"and enter the way to study on this phenomenon. Through widening its intension definition, we can include all the resembling existing in the actual life of our country into it. Through clarifying the close relation between it and administrative law from the characterized historical background of development of the third sector in our country, we can lead it into the sight of administrative law. On this foundation, this thesis has discussed the theory and practice meaning of administrative law which is related to the rising for the third sector. And it points out effective routes of ruling by law, what made the development of the third sector to the administrative law.
