Research On The Problems About The Objective Factor Of The Bribery Crimes

Aiming at the argument about the objective factor of the bribery crimes between theorist and practitioner, it is discussed in this article, on the basis of comparing the objective factor of the bribery crimes in China with that in other states and areas, as that the objective factor of taking advantage of situational convenience prescribed in internal criminal law, the nature of the crime and the new modality of bribery crimes at present, the object of this crime and so on. Then the proposal of amending the clause of the criminal law is put forward after suggestion that learning from foreign legislation, delivering the commitment in the Anti-Corruption Convention, enlarging the range of bribery to property, material benefit and immaterial benefit. Finally, it discusses that"for others'benefit"is not only the necessary factor of the bribery crimes, but also the objective factor.
