On Crime Of Accepting Bribes

With the deepening of China's reform & opening up and the establishment of socialist market economy, accepting bribes happens at very high frequency among the occupational crimes. Furthermore, the crime continues to take on new characteristics as social situation changes. Hence, legal penalty and theoretical research face new subjects of study. In order to crack down and curb crime of accepting bribes more effectively, this thesis shall begin with the current situation of the crime, and carry out full discussion about its legislative evolution, crime constituents, choice of penalty and legislation from the perspective of comparing with those of Hong Kong, Taiwan province and foreign countries. Based on the above, the thesis shall also put forward relevant suggestions to perfect the legislation of the crime so that its conviction of crime and measurement of penalty can have legal basis in accordance with reality among concrete judicial practice.This thesis only probes into the national staff member's accepting bribes. The non- national staff member's accepting bribes of companies and enterprises is not within the discussion range of this thesis.
