Relevant Study On The System Of People' Congress Supervision

The national people's congress system is china's fundamental political system. Duties of the people's congress have been considered as legislation and supervision, especially, the latter function. While, in reality, the supervision right of people's congress is reduced into a feeble situation. Not only defects of institutions, but also some weakness in administration makes the result. On the base of the supervision right of people's congress, this paper analyzed the Supervision Law, illustrated the existing problem of it, and gave some feasible suggestions.Part one: Definition of the supervision right of people's congress. This part was to illustrate the history of the supervision institution, show the highlight of Supervision Law in legislation, and explain definitions of .the supervision right. Furthermore, this part also clarified the function and position of the right.Part two: Analyses of the basic supervision institution of people's congress. Above all, this part listed four rules of enforcement of supervision: legitimacy, democratic centralism, acceptance of supervision and openness. Secondly, it referred to basic contents of the institution: subject, object, and supervision.Part three: Problem of the existing supervision institution. In the sight of legislation and enforcement of Supervision Law, this part concluded some problem of nowadays supervision institution, which based on subject, object, procedure and looked like poor supervision by law, low authority of people's congress, poor capacity of the deputy in participating in the management and state affairs, etc.Part four: Suggestions. This part referred to how to improve the supervision institution. First of all, it was important to clarify the basic rules of the reform——distribution of power and justice of procedure. Secondly, it should be established including some kind of equal selection system, professional committee system, and supervision of implementation of the budget of standing committee, to avoid inequality and poor public finance. Thirdly, there were some suggestions at those aspects, such as personnel, case supervision, question system, etc.
