"Convention On Biological Diversity" And Biodiversity Conservation In China

In recent years, although China has embarked on the path of sustainable development in economic and social fields gradually , the current environment, and the resource situation in China is still not optimistic. Due to overfishing, marine engineering, production and living discharges, a decline in the quality of the marine environment has continued , and what's more, marine biological resources has dramatically decreased, marine ecological structure has loosed balance, the sharp decline also happened in marine species, biodiversity areas. At the same time, the ineffective management measures and inadequate capacity in marine and coastal biodiversity conservation have exacerbated by the deterioration of the resources.Marine biodiversity protection involves cross-border issues that require international cooperation to solve them. In the December 29, 1993 ,"Convention on Biological Diversity"enterd into force ,which is one of the most important international treaties in the protection of marine biodiversity . It can be seen as a milestone for the development and entry into force of global biodiversity conservation . The first time the"Convention on Biological Diversity"made a comprehensive elaboration of the contents of the access to genetic resources and use, transfer of technology and biosafety, from the establishment of protected areas system to rehabilitation of degraded ecosystems and the restoration of threatened species, including exsitu conservation measures.Many domestic scholars have carried out some research on the"Convention on Biological Diversity"about the background, the implementation of the development process .at the beginning of the new century , espesically since"the United Nations Convention on the Law of the Sea"came into force, it has so few scholars specifically studied for and explored the system of the"Convention on Biological Diversity"and marine biodiversity protection , and the relevant foreign scholars also written less. Based on this, this paper attempts to combine"Convention on Biological Diversity"with the China marine conservation ,and found the role o"fConvention on Biological Diversity"on China's marine biodiversity protection and the role of reference, reflections on the convention further refinement and development of China's marine biodiversity protection in promoting and enlightenment.This paper first studies from the start, opening on the"Convention on Biological Diversity"in the background, objectives, main topic of discussion,the characteristics of the historical development of the convention on the operating mechanism, and the implementation of new development; Then, explore the"Convention on Biological Diversity"operational mechanisms and the protection of marine biological activities; On this basis, take the protection of marine biological of China as main line, expounding on China's implementation of the convention, from China's legal protection of the marine biological mechanisms specified in the design and specific facts of the current situation and putting forward practical shortcomings of the existing problems analysis; Finally, through the presentation of Russia, the United States and other developed countries in the protection of marine life and the implementation of the convention and advanced features of the proposed improvement of the protection of marine life, enhance the country's ability to compliance recommendations.Overall, the focus of this research and innovation mainly concentrate on exploring the characteristics of the reference , trying to with dynamic perspective, founding the specific operation of the convention on the evaluation of both the background and the deeper meaning of the convention ,at the same time to identify the problems that exist in practice and explain why. Papers aims to address the central question that how to build a set of marine organisms suitable for China's conservation status, shaping our international image of the mechanism, China's marine organisms to be more comprehensive protection, and take the road of sustainable development of the ocean. The purpose of writing this paper, is by analyzing the operation of the CBD and the protection of China's marine biological status of the development of the cause, closely linked both to international treaties of international law embodied in the model ,and found how the parties in the operation of the domestic legal system turn into international law domestic law .
