| With the improvement of human scientific and technological level,the ability to exploit and utilize marine resources is also increasing in an explosive manner.The degree of exploitation and utilization of the high seas has made a qualitative breakthrough compared with the past.The high seas are no longer inexhaustible,the accompanying problems of environmental degradation and Biodiversity Destruction on the high seas have gradually come into the vision of the international community.By combing the United Nations Convention on the Law of the Sea and the Convention on Biological Diversity,the author points out the problems of Biodiversity Conservation on the high seas,then,in view of the threat to the protection of high seas biodiversity and how to resolve the contradiction between "freedom" and "protection" in the context of the existing legal system,how to interpret and apply the interface between the two conventions is analyzed.This paper is divided into six chapters to study and analyze the protection of biodiversity on the high seas.The first chapter is the introduction,which briefly describes the research background and purpose,research status and research ideas at home and abroad.In the second chapter,the protection of biodiversity on the high seas is divided into three parts: "high seas","biodiversity" and "protection".Finally,the protection of biodiversity on the high seas is defined by law.The third chapter analyzes the source of international law of high seas biodiversity protection,and finds out the existing problems of high seas biodiversity protection.The fourth chapter takes the establishment of high seas protection areas on the high seas as an example to explain the contradiction between the practice of high seas biodiversity protection and the modern high seas system.It is believed that the high seas biodiversity protection should be generally accepted by the international community,and the first thing is to solve the problem of coordination with the modern high seas system.The fifth chapter analyzes the practice of biodiversity protection on the high seas,and holds that more legal support is needed to realize the protection of biodiversity on the high seas.The sixth chapter analyzes the global legal system of biodiversity protection on the high seas,and puts forward why and how to build the global legal system of biodiversity protection on the high seas. |
