This paper is the question I always think about in my secondary school teaching in the rural areas for more than 10 years. Minor crime becomes a serious problem in the countries in the world without exception, and attracts great concern of people from all walks of life including politicians, jurists, educators etc. Statistics from China Youth Research Center show that juvenile delinquency has been a gradual rising trend in recent years. From the point of subject of crime, juvenile delinquency tends to be at a younger age; from the means of the crime, minor offenders show the features of using brutal and intelligent methods; from the type of crime, property crime, violent crime and sexual offences are the main form of juvenile delinquency. Also there is an increasing number of drug-related cases; from the criminal organization, gang crimes is the main form of juvenile delinquency. Juvenile crime has become a relatively independent system of academic disciplines. There are many wrings on juvenile delinquency at home and abroad. The theory of it is also quite rich. About the analysis of the causes of crime among minors, today's mainstream point of view is from the perspective of schools, families, social, the subjective and objective factors. But most of them are too general and broad.Partâ… tries to focus on the following aspects: (1) from psychological point of view, the paper traces the minors' psychological track of crime, pointing out that the worsening of the current polarization of rich and poor, corruption and other serious social injustice caused the psychological distortion of minors' and they are an important factor to crime; (2)Also the article focuses on the growth environment for juveniles, pointing out that with reform and opening up, a large number of rural population move to the cities, the emergence of "left-behind children " phenomenon leads to the lack of supervision;Partâ…¡is about the punishment principles of juvenile delinquency. The mainstreamviewpoints are as follows: they believes the minor's thinking and personality has not yet taken shape, also juvenile criminals are physically stunting, so they blindly insist that juvenile delinquency be exempted from punishment. They neglect the function of penalty of the criminal law, ignore the protection of the victims while protecting the criminals, resulting in a new injustice. This paper hopes, based on empirical analysis of the current juvenile delinquency, to introduce non-penalty punishment measures on no criminal liability criminals who conduct seriously harmful social behaviors, and to increase relevant provisions and to extend the scope of the provision concerning the criminals of relative age of criminal liability. At the same time, about whether to use fines or deprivation of political rights of juvenile delinquency, the author puts forward his own ideas so as to discuss with the readers.
