Information Technology has extended into our whole personal lives in today's digital, informational and fast-developing society. The ways in which we live, work, communicate and entertain have been faced by a fact that computer, internet, distance learning, E-Business, electronic bank and E-Government have become a necessary part of our lives. It seems that the ongoing updating project of ID card will become a decisive change for digitalization in China. The project, which called as"biggest ID card project in the world"by Wall Street Journal, is going to bring great influence on the future of China. It will be a new challenge for government to identify, transfer and store information of civics in information management. The ID card, which only act as the proof of identity and household registry of civics in the past, will become a multifunctional"smart card"which can provide personal information including identity, name, image, reputation, financial situation, social insurance, hospitalization insurance and so on. This"smart card"is going to be the"key"to your future in the inevitable digitalization. Concerning the challenges the card will bring to, it's necessary for us to acclimatize ourselves into it, so is the law. In this paper, the author will discuss the legal problems the smart card brings under the guide of rule of law, probe the problems and try to figure out solutions.The paper includes 5 parts. Brief introduction about the academic background, theoretical foundation, status in quo and significance of the smart card research will be made in part 1. By summarizing academic research , the author tries to probe that how the smart card which stores both public and personal information to attain the balance between information security share in information era.In Part 2 the author author will take"gold card"-- which is one part of"three-gold project"in China -- for example, discuss the social effect and possible problems concerning the multifunctional smart card as ID cards in informational social progress by making comparative analysis both inland and overseas.The principle part of the paper is consisted of Part 3, Part 4and Part 5. Analysis of the security and share of both public and personal information which is included in the multifunctional card, definition of legal obligation and liable subject, policy on information security and share, application of authentication system and security key which safeguard information security, and countermeasures to the financial supervising reform, all above will be included.
