On The Improvement Of Autonomous Legislation's Supervision System In Minority Areas

Our country is a unified and multinational country. To implement regional autonomy for nationalities is the basic policy for solving nationality questions in our country. Our country establishes the regional autonomy for nationalities system through constitution as a basic politics system in our country, and entrusts with self-government organs of various national autonomous areas widespread autonomy. The legislation autonomy resides in the first place among all the autonomy in regions of National autonomy, and becomes the foundation of the autonomous authority structure. The legislations in regions of national autonomy which based on the legislation autonomy with the local legislation attribute is an important constituent of our socialism legal framework. With the development of autonomous legislation, the relevant autonomous legislation supervision system has been established. The legislation autonomy is a public power. According to the contemporary idea of rule of law, any public power's exertion should be supervised.The autonomous legislation supervision which is an important constituent of the whole legislative supervision system is that the subject of legislative supervision examines the activities of autonomous legislation of the self-government organs. The autonomous legislation supervision which based on the division of power between central authorities and autonomous regions, high authorities state agency and self-government organs, is a local legislative supervision with value orientation of maintaining the consistency of legal system and protecting the legislation autonomy of self-government organs.In the past several dozens years, the autonomous legislation supervision has achieved great successes in maintaining the consistency of legal system and heightening the quality and efficiency of autonomous legislation in regions of national autonomy. However, there are still many problems and insufficiencies on the autonomous legislation supervision, such as emphasizing the consistency of legal system but neglecting the protecting of legislation autonomy, emphasizing inner supervision but neglecting outer supervision, lacking essential procedure protection and so on. Many autonomous laws and regulations couldn't be enacted and those which were enacted with lower quality have close relationship with the imperfection of autonomous legislation supervision. The autonomous legislation supervision need to be perfected further.For improving the construction of democracy and rule of law in regions of national autonomy, it is imperative for us to perfect the autonomous legislation supervision system. Combining the successful experience of other countries with the reality of our country, a perfect autonomous legislation supervision system can be established. To achieve this object, we should perfect the procedure of authorized system; establish and perfect liability system of autonomous legislation supervision, legislative hearing system and laws and regulations cleaning up system. In order to provide theoretical and practical foundation for the further development of autonomous legislation supervision system, we should also explore judicial supervision on autonomous legislation and relief system of autonomous legislation supervision.
