International technology transfer is a direct way to develop national economy and enhance technology level. The present technology transfer has become the main contents of international economy cooperation. Introducing the advanced technology from the whole world and fully taking use of technology innovation adopted from the developed country can accelerate the speed of technology improvement for developing country. Also, via technology inputting, countries can shorten the time of study, and save capital as a result, comprehensive competence is strengthened.Fast development and hot competence of international technology brings giant effect to many countries in the field of economic development. Therefore, no matter the supplier or accepter of technology make up a lot of laws and regulations concerned with technology transfer and update regularly to strengthen their control of technology transfer. The necessary reason for a country to control the technology transfer is based on two sides: one of them is economic benefit and the other is politics gambling.The law used for countries to carry out their control against international technology mainly includes two aspects, i.e. legal system from inside the country and international agreements. For example,《Paris Convention on the Protection of Industrial Property》,《Patent Cooperation Treaty》to protect industry property. Also, there is TRIPS under the system of WTO. The above legal systems have important effect on the technology transfer through regulating the action of technology holder and receiver.Although the economy of China increased in a high speed this decade, the old economic and politic systems restrict its development of technology, China is still drop behind many countries, so we want to see about the technology transfer systems in USA and Japan, use them for reference, and analyze the shortage of us, discuss the institutional reasons and try to give some suggestions. We hope our national technology transfer systems especially, the legal control measures can be improved and we can reach a new stage.
