A Study On The Tourism Law

Tourist industry has already become a fast developing and prospective new industry in the world, and plays an important role in the world economy. Since the 1990s, the tourist industry gets rapid development and becomes one of the greatest industries in the world. After the reform and opening-up, the tourist industry has achieved great developments, and occupied great proportion in our economy. However, the legal system concerned with tourism still falls behind. Although the related governments have set up some concerned tourist laws and documents, which have contributed greatly to our tourist developments, construction of tourist law has some lagging. So it is high time to introduce the Tourism law. This thesis aims at the extensive research on the law, and comprise of three chapters.The first part is devoted to both the general theory, involving the concept, the characteristics and presentation, and our legislation, concerning the history, the imperative and the shortcoming.The second part goes to the model of legislation and fundamental principle of the Tourism Law. As far as the model is concerned, we should pay attention to our realities and the national experiences. When it goes to the fundamental principle, importance should be laid on the protection of rights, continuous development and openness.The third part concentrates on the framework and the basic systems. Firstly, our Tourism Law should comprise of the general provision, the specific provision and the attachment. Secondly, an overlook of the law is mentioned. Thirdly, basic systems such as tourism supervision, the exploit of tourism resources and the licenses and management.
