Penal Individualization

There is a mainly trend existed in modern penalty system, called penal individualization. It's development marks the advanced degree and civilization of the country's execute system. In the modern penalty system, penal individualization means to base on the punishment of freely penalty. The graduation thesis targeted to point out the penal concept, position and value, internal relationship both penal individualization and relate to the concept. I'll trace the history of penal individualization and foreign situation about it, analyse and design the penal individualization and it's idea pattern.Enthusiastic academic circles has been concerning in penal individualization, in fact, our country study work was more later than other countries. We not only have a long distance in theory, but in practice also. Frankly, we had few research results about it. In the past, our country intentionally evaded the theory of penal individualization, as named after it Chinese name. it made some scholars who were very familiar with it being confusion. So far, penal individualization hasn't systematic been studied yet. People only learned it from some professional books. Most of them didn't do the research deeply and broadly on it. In generally speaking, that the study was really didn't meet the needs of penalty today, because penal individualization's degree was very low. It has never suited for our socialism progress, thinks to no idea penal individualization known.The author of this article try to apply analysis, comparison and logical methods, based on penalty , jail and biology theory, to analyse several penal individualization cases, then, to describe the idea penal individualization pattern and approximately practice penalty.The article is divided into five parts.The first part is introduction about penal individualization concept. Author parts the concept into four parts. The second part is briefly introduction about penal individualization history and foreign situations. The third part is about elementary theory of penal individualization. There are three elementary theory in it. The four part is about the current situation and problems. The five part is about idea pattern of penal individualization. The contents were divided into three stages: classificatory individualization, correctional individualization And estimative individualization. Epilogue, in this chapter, states author's suggestion.The author has undertaken the penalty work and very known it useful in the concretely practice. The article is inclined to study and analyse our county's penal individualization, based on some theory scholars and practical experts, then, to improve it.
