Research On The Protection Of College Students' Rights In China

In recent years,due to the continuous advancement and deepening of the rule of law in China,schools governed by law have played an increasingly important role in building a modern university of law.In particular,because of the increasing awareness of the rights of students in colleges and universities,the number of disputes between colleges and students is increasing,and it has been gradually concerned and discussed by public opinion.The important reason for these cases is mainly due to the fact that colleges and universities have more emphasis on the management order of the school when they exercise their management power and despise the protection of the rights of students in school.There are many problems in the daily management work.In the final analysis,this should be caused by the conflict between the autonomy of the university and the basic rights that students in school should have,such as the right to education.Therefore,under the background of China's colleges and universities,correctly grasp the legal status of colleges and universities,sort out the legal relationship among college students,analyze the legal attributes of colleges and universities,and understand the scope of judicial review education administrative cases.It is a problem that must be solved urgently.Its construction and perfection are directly related to the rule of law management in China's universities and the rule of law construction in the whole country.To this end,the author collected some classic cases of education administration in the early stage of thesis writing,and consulted many books and materials in this area,and accumulated a lot of materials.In the writing of this article,the author mainly uses case analysis method,value analysis method,literature data method,comparative research method and other methods.This paper intends to firstly introduce the students' rights to be infringed by the integration analysis of several typical "college students' prosecution alma mater" cases in China.Secondly,it explains the concept of university rule of law management and student rights,and analyzes the rights of college students.The legal nature and attributes of school rules and regulations,the relationship between the rule of law management and the protection of student rights in colleges and universities.It also summarizes the shortcomings of college students in the rights and remedies,and finally puts forward some constructive suggestions for improvement on the lack of student rights relief in colleges and universities in China.
