Discussing Of Establish On Personal Credit Legal System

Market economy is not only legal economy but also credit economy. Compared to enterprise credit and government credit, our personal credit has no further development indeed. On one hand, people in china are influenced deeply by the conservative ideas, and they hardly make excessive consumption. On the other hand, no legal guarantee is provided to the one who deals with the personal credit for the lack of personal credit regulations.The author chooses such a realistic issue, trying to discuss the personal credit legal system as a whole and make further discussion on its importance and difficult points. Starting from the realistic practice in our country, the author learns a lot of experience from the legislation of America and Germany and uses the method of macro-discussion to form his view on the construction of the national personal credit system. And the author expects that he can make his own efforts for the system.This thesis falls into five parts. It discusses the issues of personal credit legal system construction from surface to inside. It is a preface in the first part. The second part deals with some related concepts and then states the inevitable link between credit and market economy, and points out the important role of personal credit legal system through jurisprudence interpretation of personal credit and economic analysis of personal credit legal system. The third part introduces and analyses the current legislation of personal credit legal system in China, and points out the problems there and the necessity of personal credit legal system construction in our country. The fourth part learns the experiences of the legal system in American and German and gets inspiration of our personal credit legislation. The fifth part is the legislative advices on the personal credit legal system construction. The author thinks that w should have a comprehensive 'Chinese Personal Credit Law' and concentrates on how to set up it.With the improvement of socialist market economy system in china, it is an emergency to set up and improve the personal credit legal system. This thesis is trying to promote the construction of personal credit legal system and make all the efforts to improve personal credit legislation in China.
