Study On The Regime Choices In Early Years Of The Republic Of China (1912-1923)

As an inalienable constituent of political organization , regime now speeds up the formation ,the development and the consolidation of a country , now leads a country to destruction.Therefore , to a country , the choice of regime is of great significance.At the very begining , this paper defines the regime and the relation between regime and form political organization , elaborates the theory foundation of regime choice , holding that regime can be chosen with ration and meanwhile restricted by various inner and outer factors. Commenting on the features of cabinet system chosen by Provisional Law of the Republic of China and Constitution of the republic of Republic of China in1923 , as well as features of peresidential system used in Provisional Organization framework of the Republic of China and Law of the Republic of China , this thesis then analyzes the hardships for the republic of China to get to the road of the democracy republican regime in its early time , explores the reasons why the four constitutions mentioned above chose the cabinet system and presidential system , especially concentrating on the scene of power-struggling among vall parties , factions and interest groups in the process of regime formation. What's more , studying closely about the implement of the form of regime organization of the above four constitutions , this paper also finds out that the democratic constitution has never been or has never been truely applied in spite of the fact that the text of the constitution had become the tide of history , and that the democratic constitution , as the way to make China to be a powerful country , was accepted by her nation in concept. As a result , the majority of the people did not get read democratic rights and freedom and suffered great despotic pain from the beemingly"republicanism". In contemporary China, the resonable structure of polity should be the result of the party and the various interest groups's rational choice based on Chinese political, historical, social, and cultural, and also should also be the fruit of a compromise, but not an ideal flower. We should constantly improve the relationships among the three powers and establish a constitutional China.
