A Research Into The Legal System Of Social Security In Xinjiang Production And Construction Corps

Social security is a fundamental social and economic system,is the most basic livelihood issue.Social security,as a social safety net and shock absorber,is an unreplacable institutional arrangement for promoting economic and social development.It is also an important part in building harmonious society.The 16th CPC Congress set the grand goal of constructing a well-off society.The Fourth Plenum of the 16th CPC Congress proposed the aim to building "a harmonious socialist society".The party's Sixth Plenary Session put definetely that by 2020 the basic social security system covering urban and rural residents should be established. The report of the 17th CPC Congress pointed out that "the social security system should be quickened on the basis of social insurance,social relief, social welfare;regarding basic old-age,basic medical care,the minimum livelihood guarantee system as the focus,regarding charity system,and commercial insurance as a supplement".During the course of building harmonious socialist society,realizing the goal of well-off society, without the well-off of western regions,the whole country's well-off may not consolidate;without improvement of the social security system for western regions,the society will not harmonious and the country's social security system is not complete.The Xinjiang Production and Construction Corps,located in the Xinjiang Autonomous Region in the northwest frontier,is the only China's special organization integrated the functions of the Party,government and corps in one.It bears the responsibility of farm reclaimation and frontier gaurding and is administrated by the central government and Xinjiang Uygur Autonomous Region.It has provincial power and implement the national economic and social plans independently. So the improvement of its social security system is particularly important.However,due to the speciality of the Corps and lack of talents and backward of reform and the research,There are many theoretical blank spots concerning the research on the social security system of the Corps.The existing study is not systematic and deep.In practice laws and regulations are inadequate and policies can not match with the system.So it is necessary to make a deep and systematic study on the social security system of the Corps.So that some constructive advices with the corps characteristics can be provided.This paper is based on the historical analytic approach,comparative analytic approach and empirical analysis.Firstly,the writer looks back on and analyses the history of the corps,which bigins with creation of Xinjiang Production and Construction Corps and historical survey under the planned economy.Then the author reviews the system of Corps(mainly economic and social security system) and analyses the challenges since the reform and opening-up.Secondly,the writer by analysing the result of survey questionnaires and interview attempts to research the necessary of the social security system with the characteristics of the Corps and differences between the national unified security system.On the ground of the characteristics of the Corps the author puts forward a tentative plan in a targeted manner regarding the future social security of the Corps with a developing vision from a strategic height.The paper regards:the Legal System of Social Security in Xinjiang Production and Construction should consider about the following four aspects:the social insurance,social relief,social welfare.Of course,there are priorities in the four aspects.The construction and improvement of the social security system are focus.While social relief,social welfare,and special care should focus on the establishment of a sound system.At the same time,this article makes a design and rout option for the social security system of the Corps from the national and local levels.
