Considerations On Perfect The Administrative Enforcement Of Public Security Organs In Tibet

The Public Security organs of Tibet shoulders the sacred mission of sustaining the national security and social stability ,as well as defending the country's economic construction and people's lives and property. The organs have great responsibility in building a well-off Tibet, Tibet peace and harmony in the great cause of Tibet . The Public Security's work of administrative law enforcement has played an very important role in promoting of the process of ruling bu law ,of the process of building a harmonious Tibet ,and also the process of realising the Tibet antonomy.The Tibet Autonomous Regional Party committiee and Government put forward a strategy of administering Tibet by law in the Tenth Five-Year Plan.Under the guide of the thinking of ruling by law , the Public Security organs do their best to adjust the value of enforcement ,to improve the style of enforcement ,in addition,they are strive to standard the behavior of enforcement . Therefore,the work of the Public Security organs are on the way to perfect.In this article ,I have found out the problems included in the enforcement through large guantity of research on the Public Security organs'work .After that ,I have analysed the reason of the problems and pointed out some suggestions on how to perfect the enforcement of Tibet.This study is meaningful under the circumstations of ruling by law ,as it will greatly promoting the legal system of Tibet.This article can be dividede to five parts,Part one has conceptulized the meaning, characteristics operation of the process , and effective factors as subject being lawful and the principle for the job of Public Security organs's work.Part two has elaborated the meaning and importances of perfecting the Public Security organs's work,of those ,one is the historical cry for promoting the process of ruling by law. Another is the aim of establishing a harmonious Tibet.The third importance is the essential requirements of exercising autonomy power properly.Part three has summed up the current situation and problems of the Public Security organs's work. Firstly,I have analysing the situation wholely.Secondly ,I have pointed out the problems in the link of enforcement.The main problem are sa follows,one is some main bodies of enforcement are ilegal.Another problem is that there many ilegal cases concerning the ilegal of procedure. Entity ilegal cases are also found to some different extent.The analysing to the reasons of ilegal problems is contained in the forth part. For the first ,I have analysed the subject circumstations of law enforcement ,it includes three reason.One lies in that The majority of pastoralists no little about law and have low cultural qualities,which has greatly affected the work of the Public Security organs.Another reason is that the traditional laws and culture are not conducive to the work of Public Security organs.Much more ,some folk cultures are regulated loosely,which are always conflict with the content of law of administrative Penalty.For the second part,I have analysed the main body of enforcement.Nowdays,the main body of Public Security organs can not adapt to the requirment of the sciety and law.On the one hand,the value of enforcement is not adaptive to the requirment.On the other hand,the guality of law can not adapt to the work of enforcement.It can be proved by the facts of lack of conscious of enforcement responsibility,the change of law ,and the procedural conscious .For the third part ,I will analysed the elements of the systems of management and supervision. One is the ranks of the public security organs can not meet the requirements of administrative law enforcement work.The access mechanism is not smooth.Besides ,the entire ideas of management on Public Security organs have two extremes,and the political construction has greatly constraints the work of enforcement. Police are not in place which has large impact on the justice of public security administrative law enforcement .Moreworse,lack in police and money has greatly affected the work of enforcement.The system of supervision is not robust which impedes the level of enforcement.Part five refers to the ways of resolve the problems pointed out on above. Firstly, we should strengthen legal education, foster awareness of the broad masses of the rule of law to create a favorable legal environment.In order to do this ,more Propaganda on law are needed.Secondly,we should enforce the legal education on administrative enforcement.Its'main tasks are studying laws,doing well on ideological education work . Thirdly,strengthen the building of public security.On the one hand ,going on the policy of treating police differently to avoid the anxiety of the police by giving them the budget tilt.On the other hand , improve the incentive mechanism of competition in the selection of personnel, the introduction of qualified personnel, personnel management.In addition , scientific training should be given vigorously to improve the quality of police.At last,we should strengthen education and standardize police disciplinary capacity and the behavior of law enforcement.Forthly, perfect Public security organs and improve logistics support system. What we should do is establish county-level public security of a long-term mechanism to ensure funding.Sound unified funding allocating mechanism of finance to public security administrative law enforcement .And improve the management of two lines including income of administrative penalties and fees collected,as well as the expenditure of them.Fifthly,the inning legal construction calls for trying on these faces, actively explore the establishment of the long-term mechanism to improve quality of law enforcement services to the building of grass-roots level. Continue to strengthen the focus and practicality rule of legal education and training.Organize"three test"work which takes the basic legal knowledge, law enforcement handling the case files to examine the work of appraisal and letters as the main content.At the same time,we should Issued a decision to strengthen legal system,organize to work on the appraisal of quality and administrative reconsideration,and so on.Sixly,we should strengthen the supervision mechanism of the region's public security administrative law enforcement in order to force the organs not to accept the supervision of the National People's Congress, the administration of justice, the people and the community in wide range ,as well as the monitoring of media ,but also accept the inning supervision of themselves.The first thing we should do is improve supervision of legal department.Secondly,we should establish and sound administrative law enforcement system, standardize the legal system and speed up the construction of public security. The last thing we have to do is further implement the work of police to ensure the fairness and serious of administrative law enforcement .
