Japan, defeated in World War II, after a short period of several decades, has become a super economic power in the world. There are many reasons for Japan's postwar economic recovery and rapid development, but education is one of the most fundamental factors. As the former Secretary of the Japanese Education Ministry, Araki banjyufu said: "From Mingzhi Era until now, our country's social and economic development, particularly after the post war, is at an amazing rate and appeals the world's attention. The important reason can be attributed to the education development and popularity." As stated, if there is no high level of education, there will be no high-quality people, in turn which will lead that any favorable conditions, any advanced science technology and equipment can not be allowed to play their due role. The post-war history of Japan's introduction of technology has testified to this point. Thus, Japan's postwar education plays a fundamental role in its economic recovery and development. However, which means has Japan adopted to regulate education and service for the economic development? At present, China is building a harmony society and therefore a deep study on the successful Japanese experience will undoubtedly be of great practical significance.This paper, starting with basic theories of regulation laws, through the analysis of the regulation of educational achievements and problems of education regulation by analytical method, compares the similarities and differences between the two countries' legal educations, which helps learn the experience of regulating education from Japan to perfect the education of our country. This paper is divided into four parts:The first chapter gives a general idea about the basic issues in the education regulation law. Firstly, from the meanings of education and macro-control, it analyzes the relationship between education and macro-control. Secondly, by explaining the meanings of macro-control law, this part analyzes the relationship between education and macro-control law; it finally talks about the basic theory of education regulation relies on macro-control law, including regulation law of plan, industrial policy, act, tax, financial and price.The second chapter is about legal analysis of China's education regulation law. It makes an overview of China's education law development, carries out a preliminary analysis, and then sums up the achievements of regulation in China's education, such as in plan and industrial policy; at last, it points out the problems in China's education system on the regulation and analysis the mentioned problems.The third chapter deals mainly with legal analysis of Japan's education regulation. After analyzing the pre-and-post war education law development of Japan, it summarizes the achievements which Japan has reached, such as education policy, planning, industrial policies and act, then analyzes the disadvantages of Japan's regulation to education by financial laws and price regulation laws.Chapter four is about comparison of Sino-Japanese education regulation law and proposals of perfecting the regulation law of China's education. In this part, it summarizes the same points in regulating education by law and the different points about education policy law, plan law, industrial law and tax law regulating education between China and Japan. On the basis of this, from the education policy law, the plan law, the industrial policy, the financial law, tax law, finance law, the price law, the job security and so on, in view of the specific situation of China's education system, this part proposes how to improve China's education regulation law.In short, this paper by comparison of Sino-Japanese macro-control law of education, attempts to use the basic theory of macro-control law to solve our country's education regulation problems. This paper has some theoretical and practical significance on the development of education regulation in China.
