The Analysis Of China Community Correction System

In today's countries, the fastest growing areas of penalty in the implementation of the theory and practice should be community correction, this is also one of the main signs that the dominant trend in the international execution to gradually replace the imprisonment sentence by the non-custodial sentence. Conforming to this trend, Chinese 25 provinces (municipalities and autonomous regions) have launched a pilot work of community correction. As selecting this subject,the paper aims to introduce and discuss the Community Correction at home and abroad from the angles of the theory and the practice , and to put forward the suggestion and proposal of perfecting and innovating China's community correction system ,at the basic of learning from successful overseas experiences according to the existent problem of a pilot work of our community correction.This paper, with the exception of the foreword,the conclusion, is divided into five chapters:Chapter 1: The concept analysis of the community corrections system. Introducing the concept of community corrections system, basic features ,the development history and value.Chapter 2: The theoretical basis of Community Correction. This chapter disusses the theoretical foundation of the existence and development of the Community Correction from 7 aspects , including the penalty humanitarian system, the Composite On the penalty, education theory and criminal penalties for individuals of the principles, execution of economic principles, theory and deepen the reversion of criminal compensation, theory of crime on the different exchanges and labelling theory, restorative justice.Chapter 3: The comparison of the abroad and Hong Kong' s community corrections system. This chapter, selecting the United States, Australia, Japan as the three more representative countries and Hong Kong region, slightly introduces its basic situation of community corrections system, and sums up the characteristic of the community correction system of these countries and our Hong Kong.Chapter 4: The current situation and existent problem of our country community corrects system. The born, the development , the status problem,the type,the applicable situation and the characteristics of our community correction system are introduced. On this basis, The shortage and problems in four areas of China's current system of community correction are pointed out.Chapter 5: The improvement and innovation of our community correction system. I propose to add a new kind of non-custodial sentence punishment, sentencing and execution measures , to reform and improve the existing non-custodial sentence, to sound and perfect implementation of Community Corrections system, from the three areas of the legal, the institution and the team.
