A Research On Community Correction System In China

This paper mainly explains several basic issues of the community corrections system,and introduces the different characterizations of the community corrections system by different scholars,mainly including non-custodial punishment enforcement,community punishment enforcement,and criminal punishment measures.The reason why the community corrections system can be produced and developed,its theoretical basis mainly includes four kinds of ideas: the socialization of executions,the idea of penal modesty,the economic principles of punishment,the humanitarian thought,and the theory of crime labeling.In China,The community correction system started late,influenced by the thought of severe punishment and retributive ideology,people’s recognition of non-custodial sentences was not high,and it was not until the late twenty-first century that the community corrections system gradually developed.Initially,the community corrections system was first piloted in six provinces in China,and subsequently,it was gradually implemented nationwide on the basis of summarizing local experiences.For a long time,there was no special law to regulate the system,until the Community Corrections Law,which was officially adopted on December 28,2019,provided fundamental compliance for the development of the community corrections system.Now,community corrections system is in a critical period of slow development and urgent need to be improved.Based on theoretical research and combined with practical work experience,this article studied the main problems of community corrections system.Specifically,it includes five aspects: the application rate of non-custodial sentences has decreased year by year,the application rate of parole is not high,the corrections of minors lacks effectiveness,the strength of the community corrections law enforcement team is weak,and the connection between various mechanisms is not smooth.Based on the analysis and comparison of the relevant data of community correction work in various places,and combined with the situation of community correction in other regions.According to the question,this paper puts forward several suggestions for the development of the community corrections system,mainly including improving the application rate of non-custodial sentences,improving the application of the parole system,strengthening the effectiveness of juvenile corrections,strengthening the strength of the community corrections law enforcement team,and improving the connection between the community corrections system and various mechanisms.
