Research On The Protection Of Privacy Right In Mobile Value-added Services

Right of privacy is a fundamental civil personality right. At present the world more and more emphasis on the protection of personal privacy right, whether in theory or in practice, the protection of privacy right is strengthened as a trend. In contemporary society, the level of privacy right protection can reflect the country's legal construction levels and development of civilization.With the development of ever-changing mobile communications, mobile value-added services have been widely applied. It is the service that mobile operators develop all the other services on the basis of basic services for different users and market demand. Mobile phone value-added services are typical mobile value-added services, mainly have SMS services, location-based services, MMS services and so on. With the enrichment of mobile value-added service, the future of the functions of mobile terminals will be stronger, such as people's working, living, entertainment and other daily needs which are closely related to the function will be gathered to a greater extent on the mobile terminals. But science is always a "double-edged sword", with the comfortable experience of mobile value-added services to facilitate the people's lives, at the same time, infringement problems caused by mobile value-added services is more and more concerned by people. Violations of privacy right are the most common problems in mobile value-added services, such as annoyed SMS infringement on the privacy right, location-based services infringement upon other people's privacy right.The article is divided into four sections, and analyzed from the four aspects of the Concept of privacy, Analysis of privacy right in mobile value-added services, Comparison of privacy right of foreign mobile value-added services and Thinking on privacy right in Chinese mobile value-added services. The first part is the outline of related theory to the right of privacy, including the interpretation of right of privacy, privacy right features and social value of privacy right.The second part analyzed the privacy right issues in mobile value-added services, namely the mobile phone messages, cell phone positioning, "MMS" these three mobile phone value-added services in violation of privacy right, as well as their characteristics.The third part analyzed the protection of privacy right in foreign mobile value-added services, summarized the foreign legal protection of privacy right in general and for mobile value-added services in the privacy right protection to find out related ideas of Chinese mobile value-added services in the protection of privacy right.The fourth part discussed the thinking on Chinese mobile value-added services in the privacy right protect, started from Chinese protection of privacy right in mobile value-added services, then analyzed our inadequate protection of privacy right and the formation of the reasons, ultimately proposed legislative and effective measures in accordance with Chinese actual situation of mobile value-added services in protection of privacy right.
