In the country legal regime, it is very important status for the lawyer system, lawyer system's reconstruction which weighs a national government by law condition and the democracy civilized degree is important symbol. The state of a country without the rule of law perfect lawyer system is an historical backing up and society's ignorance. In China restoration and development for lawyer system has shorter times and made some progress, but there still had gaps, so we will discuss this issue theoretically and practically in this paper..In China social transition period of the lawyer system, there are various difficulties which include the lack of institutional construction lawyers practical experience and cultural environment in Chinese culture, and weakness of legal strength . This paper holds that transition period lawyer system is a complex social process in China, is process which in the traditional culture and the modern culture, the agricultural society and the industrial society, the weak legal system society and in the strong legal system society's conflict establishes gradually.Therefore, in this paper we believe that the lawyer system is a process to establish the process of reconstruction, and need to be cleaned up the lagged cultural and social obstacles or resistance from the elements gradually built up social and cultural environment, that is to say, lawyers Reconstruction is a process of social structure and re-structure, and the establishment of a mandatory mechanism for the Reconstruction of the current lawyer system is the establishment of a sound basis for understanding and practice guidance.
