The Study On Economic Law And Fictitious Economic Law

The global financial crisis triggered by the U.S. Subprime makes people concerned about fictitious economy rapidly. It is not only clearly telling people to a new economic era, but also made it clear that the economy of our time has been a direct impact on our real life. Fictitious economy is developed on the basis of substantial economy, and gradually breaking away from the substantial economy running system, formed a relatively independent operation of the system which is based on virtual property as a basic business activity object. Fictitious economy have six basic characteristics including the particularity of the nature of property, the particularity of the property market, the particularity of the property prices, the particularity of the property income, the particularity of the market, the particularity of market effect. The continuous development of the fictitious economy required us to reflect on the nature of Economic Law in order to adapt to the requirement of fictitious economy development.This article reflects on the existing theory of nature of Economic Law from the meaning of philosophical law, the meaning of Ontology Law, the internal structure of Economic Law and so on. Through the analysis of the relationship between Fictitious Economy and Economic Law and adjustment issues of Fictitious Economy come from Economic Law, this article further explores the nature of Fictitious Economic Law, considering Fictitious Economic Law is a legal system which regulates Fictitious Economic activity, and makes overall economic benefits to society as the goal, and adjust the overall relationships of fictitious economy. Fictitious Economic Law is an integral part of Economic Law, but also have different with Economic Law. Fictitious Economic Law is a legal system that is based on the objective of the overall economic benefits, and makes virtual property as the core, and adjusts the relationships of fictitious economy. As an emerging legal ideology, it is bound with the traditional ideology of the legal relationship between the formations of a certain department.This article is divided into four parts.The first part is based on the origin and concept of Fictitious Economic Law, through the emergence and development process of fictitious economy, this part define the concept of Fictitious Economic Law, deeply expounded the basic characteristics of Fictitious Economic Law at the same time.The second part is based on the Economic Law, deeply analyzing the nature and structure of Economic Law, and thus this part reflect on the nature of Economic Law and the internal structure of Economic Law, and build the rational internal structure of Economic Law.The third part links the fictitious economy and Economic Law. Firstly, this part analyze the relationship between fictitious economy and Economic Law, fictitious economy should be an important adjust object of Economic Law, followed by focused analysis of how Economic Law adjust to the fictitious economy.The fourth part compares Fictitious Economic Law and Economic Law. Through the positive and negative legal evaluations of fictitious economy, we can understand the concept of Fictitious Economic Law. This part analyzes the concept of Fictitious Economic Law to clarify the nature of Fictitious Economic Law, and then come to a conclusion that Fictitious Economic Law is an integral part of Economic Law which is a kind of premise. Based on this conclusion, this part analyzes the regulation of subject matter, and then analyzes the department relationships of Fictitious Economic Law, such a systematic analysis and study will provide legal ideology guidance on China's legislative and judicial.
