On The Law System In Foreign Capital Bank Supervision

According to the opening up pledge to foreign countries,China's banking industry had opened Renminbi service comprehensively by the end of last year.The foreign bank is about to enter Chinese market,which will have the significant influence on the competitive pattern,market order and even financial safety in Chinese banking.However,our country's legal system supervising the foreign capital bank is not perfect and the work of management is facing new pressure and challenge.To study our country's legal system supervising the foreign capital bank has the extremely important practical significance to guarantee the stability in finance industry.This paper adopts a gradual research method with a comparative analysis,begins with the introduction of foreign capital banks and its supervising system,analyzes the existing flaws in Chinese supervising system to foreign capital banks and puts forward some corresponding suggestions.This article will be divided into the following four parts:First,a brief introduction of the foreign capital bank and its supervision and management.At the beginning,the author introduces the definition of the foreign capital bank.Then the author summarizes the supervising principles and supervising requirements and contents in Basel system.Second,the author analyses the present situation of China and the supervision of China's foreign capital bank.Third,the author analyses the flaws in China's legal system supervising foreign capital banks.Fourth,the author offers some suggestions to perfect our country's legal system in supervising foreign capital banks.The paper mainly elaborates that our country should strengthen the construction of legal system in supervising foreign capital banks;should perfect our country's legal system in supervising foreign capital banks.In this paper,the author also proposes that China should change the thought in practice, should perfect the supervising method and enforce the cooperation among the female country of the foreign capital bank and the international supervising organization.
