With the continuous economic and social development and progress, the form of labor and employment has undergone profound changes, in order to produce a variety of characteristics of diversity and flexibility of the new labor relations, labor relations is one of a double major types. The so-called dual-labor relations means: working at the same time a number of employing units and the establishment of labor relations, labor relations by which the labor law, workers and the employers signed a labor contract or establish the fact that labor relations, and in varying degrees by a number of employing units command, management and disposal.The worker during the dual work relations, unifies by its sole labor force with several employer's producer goods, and participates in its production process.Dual labor relations has a lot in real life there is, however, to double China's current legal regulation of labor relations for the relevant systems is still not perfect, but there is no law in the form of double the legal concept of labor relations to be confirmed.Academic research is not its depth, and some research results also remain in the planned economy period, they have recognized that"single labor relations"as the normal form of labor relations.It is precisely because the legal system, lack of regulation, resulting in a large number of dual practice of labor relations in the interests of employees can not be effectively protected, the special groups of social insurance, industrial injury insurance issues such as lack of a unified solution.Therefore, it is necessary for the shortcomings of our existing legislation, the number of workers in the grasp of the intrinsic link between on the basis of the analysis caused by the dual labor relations, and for its typical form of legal regulation of the construction of the idea of full double play of the positive factors of labor relations in order to achieve "developing the strongpoint and avoiding the shortcoming " effect.
