The Research On Local Environmental Legislative Power Of Two-Oriented Society Construction In "Changsha-Zhuzhou-Xiangtan City Group"

On December 14, 2007, The State Council has ratified "Changsha-Zhuzhou-Xi- angtan city group" as the comprehensive coordinated reform testing region of the society construction about resource-saving and environment-friendly oriented for the whole nation. So the direction of implementing scientific development and promoting overall development in economy society and person has been ascertained. The two- oriented society construction is different from a common strategic decision because it has a peculiar purpose of realizing harmonious and everlasting development of both human and nature and mutual harmonious in economic development,population resource and environment. So setting up scientific,reasonable local environment legislative power is one of the preconditions in two-oriented society construction. At present,the environment legislative power of "Changsha-Zhuzhou-Xiangtan city group" is still bound by our traditional legislation system,only Hunan People's Congress,Hunan province government,Changsha People's Congress,Changsha province government have legislative power. Zhuzhou and Xiangtan Cities do not have environment legislative power. It leads to imbalance in these areas and this situation can not adapt to the actual need of two-oriented society construction. For this reason it is the key that reform the inappropriate environment legislative power and authorize new legislative power to legislative body.On basic of exposition in concept,characteristic,values,factors and significance through comparative method and practice analytical method,this article analyses the problems of local environmental legislative power and reasons through expressing the meaning of two-oriented society and developmental requirements,and expound the impaction of local environmental legislative power by two-oriented society construction. And bring forward the opinions which perfect local environmental legislative power of two-oriented society in "Changsha-Zhuzhou-Xiangtan city group" in accordance with the actual situation in this area from four aspects of local environmental legislative power in legal ground,principle,system and relations with other legislative power. Analyze the feasibility that carry out the authorized legislative power,learn experience of authorized legislative from Special Economic Zones and elaborate the advantage that authorize "Changsha-Zhuzhou-Xiangtan city group" to legislate,put forward suggestions which keep the legislative power in three cities balance. In addition,put forward ideas in legislative body,appraisal system,superintend mechanism of local environmental legislative power to perfect local environmental legislation.
