Research On Government Information Public Law Relief System Of Our Country

Government Information Public System is built to ensure citizen's right to be informed, to construct service-oriented government, but "no relief, no rights". Govern-ment Information Public System can't function effectively without an effective relief system. Therefore, this paper studies how to build the Relief System of Government Information Public Law all-round, to ensure that the Public System of Government Information being carried out practically, thereby, to protect citizen's rights to be informed .The author used the methods of value analysis , demonstration analysis , comparision analysis and history analysis , starting with the significance and theory basis of the Relief System of Government Information Public Law ,introducing some relief systems with characteristics abroad,to build and perfect the legal Relief System of Government Public Law.This paper has the following innovations:1 .From the inherent property of right, in accordance with the main line :Right to know→Property rights→The right to relief→Separation of powers , deeply analysis the theoretical basis of Government Information Public Law Relief System.2.Use the advantage of Japan information examine committee , United Kingdom information judge institute and information attache system for reference , combine with our country's reality,structure the open joint meeting system adapting to of our national condition.3.From angle of Evidence-Based Analysis,re-build specific system of Government Information Public Lawsuit ,for instance , shielding censorship,re-censorship. And clearly define plaintiff qualification ,distribution of testified responsibility ,and such other problems in lawsuit practice.
