Since three decades since China's reform and opening-up, rapid economic development, city the size of the building of an epoch-making, and the automobile expends climbs year after year. However, in 2008 the global economic crisis broke out, China's economic development has encountered significant challenges. The central economic work made it clear that expands the domestic demand in 2009, as a fundamental way to increasing security. The farmers' consumption, housing consumption, auto, service consumption and tourist spending will be the next step in the expansion of household consumption of the five priority areas. We may know obviously, with the strong automotive consumer promotion, parking spaces in residential areas will be more acute contradiction between supply and demand. One related to ownership disputes, disputes will be the responsibility of the public attention. In this article, by analyzing the status quo of China's legislative inadequacies, to research the right of ownership of parking spaces, as well as responsibility. Combined with the areas of foreign and compare the relevant legal system, to improve the refinement of China's Property Law of the parking spaces to make recommendations related to the system.This article is divided six parts, namely the introduction, the main text four chapters, the conclusion, its brief content introduces as follows separately.The introduction part: The main purpose of writing this article, describes research to explore the main object and the main content. Put forward suggestions to solve the city the right to ownership of residential parking spaces and the importance of the issue of liability, a matter of urgency.The first chapter: From the legislative point of view, and scholars have different points of view, combined with real life and the specific conditions of Analysis of "Property law" in article 74, and the real life of the parking spaces in residential areas the right to ownership of the impact, then analyze the causes and defects. And then address these shortcomings, How to improve the refinement of the key points.The second chapter: Presently, parking spaces in residential areas of the city broadly divided into three types: the first property is an independent garage enclosed card, the second is an underground car park spaces, and the third is occupied by residential areas on the ground of public parking spaces.
