In recent years,the quality of life of urban residents in China continues to increase,and the demand for cars from urban residents is also increasing.With the increase in the number of private cars,the problem of difficult parking has become a major problem for the owners.As a result,conflicts among owners,developers,and property companies have caused conflicts and disputes.The contradiction focuses on who the parking spaces belong to.Although the promulgation of the "Property Law" has alleviated this problem to a certain extent,it still has many imperfect places.Therefore,the key to solving the problem is to improve related laws and regulations as soon as possible.This article is based on a study of the academia's doctrine on the right to ownership of parking spaces and the types of parking spaces,a review of the status quo of the ownership of parking spaces in some countries and regions,and an analysis and critique of the current legislation on the ownership of parking spaces in China.It is mainly aimed at parking in residential areas in China.The question of the ownership of the position proposed a solution for determining the ownership of parking spaces.It is mainly divided into four parts: The first part of the legal analysis of the ownership of parking spaces in residential quarters focuses on the concepts,types and nature of parking spaces in residential areas.The second part summarizes and analyzes the current legislative situation and analysis of existing problems in the residential community parking space in China.The third part compares the legislative status quo of parking spaces in major countries and Taiwan,and finally puts forward suggestions for defining the rights of parking spaces in China.The fourth part is mainly to address the problem of the ownership of parking spaces in China's residential areas,and propose solutions to determine the ownership of parking spaces.It includes four suggestions: The first is to improve the relevant provisions of Article 74 of the “Property Law”;the second is the statutory classification system for parking spaces;the third is the registration system for sound parking rights;and the fourth is the establishment of space rights as an independent property right.system.
