| National compensation system for victims of crime is a system in which the nation use a special compensation fund already established or other capital to compensate those criminal victims who did not receive compensation through incidental civil actions or in the case the offenders was not captured. Now many nations in the world have established their national compensation systems. The UN and other international organizations also passed documents asking their members to set up national compensational systems. But, as a partner, we have not set up a real nation-wide national compensation system for victims of crime yet. However, in reality there exists several practice compensation models in our nation. These practices have played a certain role in relieving the victims' sufferings and also provided some experiences in establishing a national compensation system for victims of crime. But there also exists some shortcomings in these practices. So we need to learn its good and discard its shortcomings. At the same time we need to learn the useful materials from the compensation systems of other nations. And then use them to build a national compensation system for victims of crime of our own nation which can meet the requirement of international standard .The article includes four chapters in all. Chapterâ… introduced the concept, characteristics and legal basis of the national compensation systems for the victims of crime and discussed the relationships between it and other relevant systems, then put forward my own opinion on its legal basis. Chapterâ…¡presented the provisions of the national compensational systems for victims in other nations and international organizations, and then give my opinion, point out what we can learn from them. Chapterâ…¢discussed the compensation practices in our country, including their characteristics, deficiencies and how they worked in reality. On this basis, chapterâ…£discussed the value and foundation and then put forward my suggestions in setting up our national compensation system for victims of crime according to the reality of our own nation and the experiences of other nations. |
