The Research On Legal Nature Of Corporation Social Responsibility

Corporation Social Responsibility recently has attracted the extensive attention of the social public,which has been given comprehasive ponder after the Sanlu Milk Power event. The research purpose of this paper is to definitude the legal nature of corporation social responsibility,by virtue of making comprarative analysis with other legal concept ,for example, legal liability. legal obligation and so on, further to explain the definition and feature property, mainly analyze on realization mechanism of responsibility and then puts forward the approaches to realize it in law and morality sense.This paper is composed of five chapters, taking the concept analysis and comprarative analysis as mainly research methods. Firstly,the producing background, concept,origin of corporate social responsibility and qualitative research by some domestic and foreign scholars have been described in first chapter; In chapter II, corporate social responsibility was analyzed in elements of law, draw the conclusion that it is a legal concept and undertaking for social responsibilities is one of legal principle; By comparing with legal liability,chapter III obtained that the concept of "responsibility" differs in terms of corporate social responsibility and legal liability and the feature of them are quite different; Comparison and analysis research of the principle of legal prescription of responsibility and the way of responsibility realization is made in this chapter ,which educe that the identity comprehension on corporate social responsibility and legal liability by many scholars is wrong; In chapter four,researching on equivalence mechanism of rights and obligations,we see clearly that corporate social responsibility is unity of legal obligation and moral obligation, furthermore the obligation enterprise social responsibility is non-equivalence; The five chapter also is the key points of this paper, on the basis of comparing the reaponsbility realization of domestic and international enterprises,try to puts forward some design ideas of reaponsbility realization for demestic enterprises.
