A Study On The Legal Problems Existing In The Social Security System In China

It has been about half a century since much is done on the legislation of social security in China. Sets of laws or codes have been laid down, which plays a significant role in maintaining the present social security system and laying solid foundations for the future legislation in social security. However, the social security legislation in China, as a whole, is still lagging behind, even in an abnormal state.With the economic system in our country transforming from planned economy to socialist market economy, it is of great significance to establish a legal system of social security for the sake of guaranteeing the smooth reformation and the people's well-being. Nowadays, still, some problems can be found out in the system of China's social security legislation as follows: shortage of overall planning, incompleteness, more vacancies, fewer Congress legislations, more executive regulations, low quality, in disorder, out of balance, multiple views, abnormality, weak enforcement and absence of management law etc. Therefore, on the basis of legal analysis of social security and a comparative study on the social security systems home and abroad, a comprehensive discussion and investigation about the existing lawmaking problems and its causes are presented in the dissertation. What matters is that the author not only puts forward the value tendency with Chinese characteristics in China's social security and principles to abide by, but also develops fully the legislative requirements for legalizing social security so that social security in our country can be perfected.
