The Protect Of The Criminal Law On China's Social Insurance Fund

Social insurance fund is the cornerstone of the social insurance system to protect the workers in the pension,health care,work injury,unemployment,fertility and other aspects of the fundamental rights.It also plays an important role in reproduction of the labor force and maintain social stability.In reality,against the security of social security funds,with a great social harm.The existing legal protection of social insurance funds means homogeneous and lack of effort.The existing criminal law for the security of social insurance funds are also not able to provide a full range of protection.In this article, problems of this reality to the theory and practice from two levels of china's social insurance funds to study criminal law protection mechanisms.Response to problems in practice,it creates the social security fraud,and it also considers the aggravating circumstances in misappropriation,invasion and occupation of the social insurance fund and abuse of power,dereliction of duty resulting in loss of social insurance funds.
