Study On The Community Correction Of Minor Criminals

During the transmission period of the society of our country, the minor criminals become more and more serious. The severe minor criminal arouses serious harms to our country and society, simultaneously, results in a series of social problems. However, the traditional prevention and correction method of the criminal minors in our country is now facing severe challenges and may not be functioning well. The social correction is an effective correction of minor criminal which is widely adopted in various countries in the world. It takes full advantage of various social resources, plans social powers as a whole. Reality proves the social correction can be functioning well on the correction of the minor criminal. In our country, we have just started in this area. The minor criminals are very different from and have their own specialties comparing to the adult criminals in terms of personality and psychology. Therefore, the social correction of minor criminals shall not only have the common nature of social correction, but also have its specialties which are different from the , social correction for adult criminals. As a brand new social juries work, we do not have proper social correction administration system suitable for minor criminals. Theory and practices are basically blank. Therefore, it is necessary to establish the social correction system for minor criminal with the Chinese local specialties to meet the special psychological and biological requirements of minor criminals.This text is divided into totally five parts, about 35000 words.Part one: the introduction of the concept and theory of community correction of minor criminal. From the concept of minor criminal and community, I conclude the concept of community correction, and introduce the theories which are relevant to community correction include the theory of label, the theory of social penalty, the theory of penalty modesty and the theory of compensation.Part two: the analysis of necessity on community correction of minor criminal. This chapter is divided into seven parts, including the community correction of minor criminal is derived from the actual condition of minor criminal in our country, the community correction of minor criminal could lessen the influence of label as far as possible, could lessen the defect of prison penalty, could keep intimate touches between minor criminal and their family and the society and so on.Part three: the feasible analysis of community correction of the minor criminal. This chapter analyzes the feasibility of community correction of minor criminal on the theory and the reality. The theory is principal about the plasticity of minor criminals, and the concept of the penalty. In the reality this chapter introduces the condition of community correction of minor criminal in American, England, Japan and Germany.Part four: the reality and problem of community correction of the minor criminal in China. Firstly, this chapter introduces the conditions of community correction of the minor criminal in Beijing, Shanghai and so on. Secondly, this chapter analyzes the problems in the reality: the community correction of the minor criminal is lack of social self-identity, the community correction of the minor criminal is short of legislations support, the objects of community correction of the minor criminal is not very clear, the community correction of the minor criminal does not construct professional organizations and personnel and so on.Part five: the suggestions of perfecting the institution of community correction of the minor criminal in our country. For the problem in the reality, this chapter suggests we must enhance publicity on community correction of the minor criminal, change people' mind on community correction of the minor criminal, enhance the system of law, and construct professional organizations and personnel. In the specific part, promoting the system of personality of minor criminals before the community correction, constructing the system of correcting psychology of minor criminals, perfecting presenting penalty in China, at the same time using for reference on foreign country' experience.
