The Case Analysis To The Specific Execution On Community Corrections In Longnan City,Gansu Province

"Community Corrections" had always been focused on from the year2002, when it was first tested out, to the year2011, when it was formally written into the criminal law. According to the developing trend of international socialized penalty executions and our country’s penal legislative idea, which is "people-oriented", carrying out community corrections would be certain and workable. To realize the combination of theory and practice, the specific execution for community corrections is very important.In the first chapter, through the learning of our country’s system on current community corrections and based on the certainty of our country’s system on community corrections,it confirms the workability of our country’s system on community corrections; and from the nature on community corrections, combining the superiority and rationality of community corrections, it summarizes the advantages and disadvantages of the test. In the second chapter, from the case analyses of the specific execution on the most basic-level and also the most important community corrections, it reveals the existing difficulties of carrying out community corrections in basic-level work and the actual problems that we are facing; through case analyses, combining the knowledge of correction pedagogy and correction psychology, as well as the actual situation of specific judicial departments, it designs relatively rational plans that are targeted and workable. In the third chapter, it simply puts forward some ideas to perfect our country’s specific execution system for community corrections, to make prison corrections and community corrections complement each other, thus together to realize the rationalization of our country’s penalty structures.Because of the particularity of specific execution of community corrections, this article is different from other case analyses, which refer to the arguments and discussions about theories of law, and it is also different from other investigation reports,which are often in the form of questionnaire data. It is based on investigations and visits, and the specific case executions. On the knowledge of correction pedagogy, it designs the rational and workable correction plans, emphasizing the education of community corrections, reversing the existing execution situation that pays much attention to supervision but ignores education, so really realizing the superiority of community corrections.
