Research On Real Right Of Forest Resources

Forest resource as an important natural resource and material base of forestry production is the key point of realizing forestry economic efficiency, social efficiency and ecology benefit. At present, the theory research of forest resource's real right is not systematic, legislative system and legal systems are not perfect. All these factors are key points to restrict the development of forest. So we must put forward the advice of perfecting laws of forest resource's real right and rich the realization way of our country's forest resource to advance sustainable development of forest resource and forest industry through analyzing the situation and existing questions of forest resource's real right.The thesis uses the theory of real right and adopts the researching methods that include comparative analysis, historical and reality analyses and legal economy analysis to give the deep research about relative law questions of forest resource. There are three points in the thesis. The first part explains the definitions of forest resource and limits the basic meaning of forest resource's real right with using the method of comparative method, and analyzes the inner feature of the forest resource's real right with giving the basic definition. At same time, gives the analysis of present status of forest resource's real right to providing reality basis. The second part analyzes the existing problems of forest resource's real right according to the present situation with using the research methods that include historical reality analyses and legal economy analysis in order to create condition for solving the relative questions in the field of real right in the legal system of forest resource. And the problems include that inner structure of forest resource's property right is unreasonable, realization form of the profit real right is not perfect, the legislation standard of guarantee real right is impact, and forest cutting right has theory controversy and practical difficult. The third part puts forward the basic mentality and frame for perfecting the legal system of forest resource's real right from four aspects aiming at the existing problems. The four part aspects include defining and standardizing the property right of forest resource, displaying the power of forest resource's profitable real right, enriching the mortgage form of forest resource's guarantee real, building the prepared system profitable real right of forest cutting.
