Research On Reformation Of The Executive Procedure Of Reeducation Through Labor

Reeducation-through-labor system has been created since 1957.By more than 50 years of exploration and practice,it has formed a unique program schema,that handling cases reporter by public security organs,making decision by reeducation-through-labor,administrative committees, executing by reeducation-through-labor institutions,and supervising by people's procuratorates.The executive procedures is the last one of re-education through labor.More than 50 years,re-education through labor system has played an important role in preventing of crime, keeping law and order,and maintaining social stability.And these effects have been achieved through the executive of procedures.Nevertheless,there are still many abuses in the executive procedure of re-education through labour in the links of acception,change,releasing,and in the course of applying of management,education and producing.And there are many reasons for the formation of these abuses,not only in system design, violation in practice,but also in culture.Therefore,both departments in theory and practice of judicial have been carrying out some useful reflection.The thesis focuses on,reformation for the executive procedure of re-education through labour is imperative.First,in the idea of legislation,we need to change from national superiority to Human Rights protectionism,and insist in transformation whose ideas are law and people.Second,in the aspect of innovation in way,we should break the original form which is highly obturated,forced to working,and unitarily educated,just like prison.And we need to replace them with the introduction of scientific methods of treatment,and diversiform management that open to the society,extend to the families of the people undergoing the education-through-labor program,and infiltrate to the addicts.Still,we need to perfect our legislation in system design and unification,content regulation,and healthiness of supervision and relief mechanism.So that re-education through labor system can work better and achieve its aim.This article discusses on four chapters Chapterâ… is mainly to define the executive procedure of re-education through labour from connotation and extension.Chapterâ…¡discusses on the current legislation and practice of the executive procedure of re-education through labour,also,the abuse in it.Chapterâ…¢is to exoatiate on the value of the executive procedure of re-education through labor reform,from four parts,realization of justic of process and entities,protection of the human rights of addicts,the establishment of social stability and law,elimination of international adverse effect.Chapterâ…£is to put forward three reformational countermeasures of the executive procedure of re-education through labour,to transform ideas,to innovate methods,and to perfect legislation.
