Study On The Countermeasures Against Chinese Official Corruption Under The Framework Of The Rule Of Law

Corruption is an act that public officials violate or deviate from their duties, use or abuse of public power entrusted by the public to damage the integrity of public office, violate the order of the public administration and injure the public interest. Anti-corruption has always been an important political task of the Communist Party of China and the Chinese government; it is also a general concern and sensitive social issue. Since the founding of China,anti-corruption in our country has experienced three stages, namly, mass-movement anti-corruption, the power management and the system management. It has achieved remarkable results by means of moral education, social supervision, the legal system and comprehensive management. However, the flaws which the traditional path itself has should be ignored.China's traditional countermeasures against Chinsese official corruption had an obvious tendency on non-rule of law. Currently, we advocate and practice the"rule of law". Building the rule of law requests restrictions of power, prevents abuse of power and corruption. We are building a system to anti-corruption, we bring mechanisms like education, systems, and supervision into the legal track, the work is an important aspect of the rule of law. Countermeasures against Chinsese official corruption under the framework of the rule of law has its own unique advantages. It is of great value to use legal system to anti-corruption, the rule of law is the basic and core demand to countermeasures against Chinsese official corruption, China's preventing and controlling system must put education, system and supervision into the rule of law.Based on the condition of our country, under the framework of the rule of law we need to explore and think from the conceptual level, system level and action level to anti-corruption. First of all, the values of the countermeasures against corruption must fit the spirit of he rule of law, they must achieve the limited and effective power; Secondly, we should determine the targeting of the formal system of rules and adopt the good law to anti-corruption; Finally, we should consider adopting compromise strategy by means of appropriate principles of anti-corruption , establish a relief mechanism to deal with bad issues in the course of anti-corruption . We should also take special and conventional countermeasures against Chinsese official corruption to promote the job of anti-corruption.
