The Dimensional Deconstruction And Research Of Community Treatment In China

The community treatments develop under the background of the socialization and the humanization of penalty execution, which reflects the development trend of penalty system from the imprisonment to the socialization of penalty execution. The community treatments have been well developed in western countries, and the theory also nearly perfect,which could be used for reference and have a very deep significant meaning to our country's community corrections development.In recent years, under the"Criminal Punishment Evolution"theory, the Criminal Sanction system reform has become a hot issue. And the transplant of Community Correction system is high hoped to solve many problems of the Chinese Criminal.This paper in proper is made up of six parts:The forewords give an introduction about the development of community treatments at home and abroad, also about the research situation and the aims and methods of this article.Chapter 1 mainly focuses on the outline of the community corrections including the clarification of some concepts concerned with community corrections and the definition of the concept, then the common and different characteristics shared by other concepts in community treatments.Chapter 2 gives out the concept of Community treatments and general situation in China's practice, and argues on several defects and deficiencies existed at present. By analying the existing specific representations,"Community"is defined as a regional one which is made up of a certain number of residents with the inherent interaction and cultural tie."Treatment"does not only mean execution, but also includes the managerial and educational activities executed by prisons and other executive bodies. Then, the essay considers the theoretical basement of community treatment. Responding to the inherently need of the social development and evolution, the criminal policy is converted to country &community-based type from the country-based one. Community, as an important role of public management, steps into the field of national public government administration. Meanwhile, Community Treatment is the requisite for implementing the basic penalty function, which contains the change of educational punishment instead of retributive punishment, and is a result of interaction of three principles: individualization of punishment, balance between crime punishment and suiting punishment to crime.Chapter 3: The paper tries to find out the problems of our country's community corrections by the comparison between the foreign Community Treatment system and our own. This part lays out the current situation and condition of Community Treatment. Since the pilot project in the community being launched, there are some problems such as the fuzzy power level of executive subjects.Chapter 4: Building and advancing of Community Treatment. This is the core of this dissertation. It is the key foundation to strengthen the community's awareness to play a role in the Community Treatment, to construct ripe Community with Fengqiao Experience, and also cultivate the team of executors, which leads to the success of.The conclusion prospects the development of Community Treatment in China, and provides the theoretical and practical significance of this article.
