Research On Intermediate Punishment In Community Corrections

Since 2003 China began the pilot work of community correction, has made achievements in experimental work involves, the recidivism rate, institution-building, and through the amendment of criminal law eight in 2011, officially confirmed the community correction system from the legal level. Nevertheless, there are still many factors restricting the development of Community Correction:national legislation is not perfect, operability is not strong; not balance regulation, education and assistance in the relations between; in failing to scientific and rational classification of delinquents lead to unfair punishment and so on. These problems have seriously hampered the smooth conduct of Community Corrections in China.US intermediate punishment as a new form of community correction system began in the 1980s. It is situated between the traditional forms of sanctions and Community Corrections sentence of imprisonment and by depriving some ability and a certain control to ensure offenders with targeted, real punishment. Under the current legal framework, our country can learn actively from the advanced experience of the US intermediate punishment, and explore the Chinese-style intermediate punishment mode actively, in order to effectively promote the smooth development of Community Correction.By describing the US intermediate punishment system and the status quo of China’s Community Corrections, I proposed the intermediate punishment as Community Corrections specific execution mode, in order to improve our community correction, play the role of punishment to punish crime, maintaining social stability.In addition to the introduction and conclusion, it includes the following chapters:Chapter 1:Significant necessary of Community Correction to introduce intermediate punishment. Our community correction is in urgent need of a new system to improve because of our current problems, while foreign intermediate punishment system gradually on the rise. By discussing the development of intermediate punishment, concepts, goals, etc. to introduce reflect current practice value of intermediate punishment.Chapter 2:Types of American intermediate punishment. In this part, it introduces the concept, characteristics, objects, etc. of the five measures:halfway house, electronic monitoring, intensive supervision program, day reporting center, home confinement,and makes a brief comment on the intermediate punishment, then points out the significance of the intermediate punishment to the community correction system in our country.Chapter 3:The idea of intermediate punishment system of our country. The path should be chosen from the pilot to the Legislation of the execution, then discusses the intermediate punishment as execution mode used in our Community Correction, and followed by the localization design of the supporting system of the intermediate punishment.
